Terms & Conditions

These Terms & Conditions govern the use of this website and the informal food ordering process it offers. They are provided in accordance with Spanish consumer protection law (Royal Legislative Decree 1/2007, the General Law for the Defence of Consumers and Users — "TRLGDCU") and the LSSI-CE.

1. About us

This website is operated by Italian Pizza Shop, located at Av. de Nabeul, 25, 29601 Marbella, Málaga. See our Legal Notice for full identification details.

2. Nature of the order form

The cart and checkout form on this website are a convenience tool to help you put together your order. Placing an order through the site does notcreate an automatic, binding sale: pressing "Send order via WhatsApp" or "Send order via SMS" sends your requested items and contact details to the restaurant as a message. The order is only confirmed once the restaurant replies to confirm availability, price and delivery/pickup time. No payment is taken through this website.

3. Prices and payment

All prices shown are in euros (€) and include applicable Spanish VAT (IVA) where legally required. Payment is arranged directly with the restaurant after order confirmation, by card (via a secure payment link sent by the restaurant), Bizum, or cash on delivery/pickup, as selected at checkout. We do not process or store card details on this website.

4. Right of withdrawal

Under Article 103(d) of the TRLGDCU, the right of withdrawal does not apply to contracts for the supply of food, beverages or other goods intended for everyday consumption that are prepared to order and/or are liable to deteriorate or expire rapidly, such as freshly prepared pizza and food orders. By placing an order you acknowledge that this right does not apply once the restaurant has begun preparing your food.

5. Cancellations

If you need to cancel or change an order, please contact the restaurant directly by phone or WhatsApp as soon as possible, ideally before preparation has started.

6. Allergens and alcohol

Full allergen information for every dish is available on request from our staff, in accordance with Regulation (EU) No 1169/2011. Menu items containing alcohol (such as beer) may only be sold to persons of legal drinking age (18+) under Spanish law.

7. Complaints

Official complaint forms ("hojas de reclamaciones") are available on request at our premises at Av. de Nabeul, 25, 29601 Marbella, Málaga, in accordance with Andalusian consumer protection regulations.

8. Intellectual property

All content on this website — text, photographs, logos and design — belongs toItalian Pizza Shop or is used with permission, and may not be reproduced without authorisation. See our Legal Notice for more.

9. Liability

We make reasonable efforts to keep menu items, prices, photographs and opening hours accurate and up to date, but they are provided for guidance and may change without notice. We are not liable for delays or unavailability caused by events beyond our reasonable control.

10. Governing law

These Terms are governed by Spanish law. Any dispute will be submitted to the courts corresponding to the consumer's domicile, without prejudice to your right to use the EU's Online Dispute Resolution platform atec.europa.eu/consumers/odr.
